By downloading, installing, or using the Park Break application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Park Break reserves the right to modify these Terms at any time. Continued use of the App after any modifications constitutes your acceptance of the revised Terms.
2. Description of Service
Park Break is a mobile application that helps users discover parks, organize recreational events, connect with other players, and participate in sports activities. The App offers free and premium subscription tiers with varying features and limits.
3. User Accounts
To access certain features, you must create an account. You are responsible for: • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Providing accurate and complete information • Updating your information as necessary You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.
4. Subscription and Payments
Park Break offers subscription tiers (Player, Athlete, Pro) with different features and pricing. By subscribing to a paid tier: • You authorize recurring charges to your payment method • Subscriptions auto-renew unless cancelled before the renewal date • Refunds are handled according to the app store's refund policy • Price changes will be communicated in advance • A grace period of 3 days is provided for failed payments before downgrade
5. User Conduct
You agree not to: • Use the App for any unlawful purpose • Harass, abuse, or harm other users • Impersonate others or provide false information • Interfere with or disrupt the App's functionality • Attempt to gain unauthorized access to other accounts • Post inappropriate, offensive, or harmful content • Use automated systems or bots to access the App • Violate any applicable laws or regulations
6. Events and Activities
When creating or participating in events through Park Break: • You are responsible for your own safety and conduct • Park Break is not liable for injuries or incidents at events • You must comply with all local laws and park regulations • You should verify the safety and suitability of activities • You participate at your own risk
7. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.
8. Intellectual Property
All content, features, and functionality of the App are owned by Park Break and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
9. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PARK BREAK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the App will be uninterrupted, error-free, or completely secure.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARK BREAK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately.
